Judge Berle M. Schiller — United States District Court for the Eastern District of Pennsylvania

Daniel comes to Marcus & Marcus with two decades of experience litigating complex commercial cases, obtaining landmark precedential victories, and recovering over $2 billion in settlements on behalf of victims of unlawful conduct. Before joining Marcus & Marcus, Daniel held a senior position at one of the leading plaintiff litigation firms in the United States, representing clients at all levels of the federal judicial system, including at trials, in the Courts of Appeal, and in the U.S. Supreme Court. He has participated extensively in litigation involving the pharmaceutical, medical device, and electronics industries, winning several important victories on state-of-the-art legal issues, including the illegality of patent settlement agreements between branded and generic drug manufacturers, purchaser standing to challenge monopolization via fraudulently obtained patents, class certification, anticompetitive bundling, and e-discovery disputes.


After law school, Daniel served as a law clerk to Judge Berle M. Schiller of the United States District Court for the Eastern District of Pennsylvania. 

 

Daniel is a graduate of Yeshiva University, where he earned a BA. Daniel received his J.D. from Temple University School of Law. 

 

Daniel is also the author or contributor to several scholarly works, including: Rule of Reason Handbook (ABA forthcoming 2024); Proving Antitrust Damages (ABA 2017); Model Jury Instructions for Civil Antitrust Cases (ABA 2016); “Parties Entitled to Pursue a Claim” in Private Enforcement of Antitrust Law in the United States (American Antitrust Institute 2012); "Who May Pursue a Private Claim?" in The International Handbook on Private Enforcement of Competition Law (American Antitrust Institute 2010).

 

Daniel’s work has repeatedly earned recognition by his peers. He won the American Antitrust Institute’s award for Outstanding Antitrust Litigation Achievement in Private Law Practice three times (2017, 2019, and 2020). He has also repeatedly been named as a Super Lawyer (2017-2023) and a Super Lawyers Rising Star (2012-2015). For many years, Daniel has also been involved in various civic organizations in various capacities, including Philadelphia Reads and the Old York Road Community Organization.
